The 2008 Melbourne Cup, the 148th running of Australia's most prestigious Thoroughbred horse race, was run on Tuesday, 4 November 2008, starting at 3:00 pm local time (0400 UTC).[http://www.breednet.com.au/Stakes-Race-IndResults.asp?racename=Emirates+Melbourne+Cup&md=4/11/2008 2008 Melbourne Cup result] It was won by Viewed.

On 3 December 2008, Luca Cumani, trainer of second-place Bauer, announced that an inquiry was underway into treatment Bauer received on the Thursday prior to the race. The treatment was a form of physio therapy that is illegal to administer within 7 days of a race; as a result of the treatment, Bauer could have been stripped of his second place.{{cite news|url=https://formguide.cyberhorse.com.au/index.php/2008120321375/Australia/Melbourne-Cup-Runner-up-Bauer-In-Probe.html?option=com_content&Itemid=39&catid=9&id=21375&lang=en&view=article&option=com_content&Itemid=39&catid=9&id=21375&lang=en&view=article&fontstyle=f-larger|title=Melbourne Cup runner-up Bauer in probe|last=AAP|date=3 December 2008|publisher=Virtual Formguide|accessdate=2010-10-11|archive-url=https://web.archive.org/web/20110706103642/https://formguide.cyberhorse.com.au/index.php/2008120321375/Australia/Melbourne-Cup-Runner-up-Bauer-In-Probe.html?option=com_content&Itemid=39&catid=9&id=21375&lang=en&view=article&option=com_content&Itemid=39&catid=9&id=21375&lang=en&view=article&fontstyle=f-larger|archive-date=6 July 2011|url-status=dead}} However, Racing Victoria announced on 4 December that Bauer would not be disqualified.{{cite news|url=http://www.abc.net.au/news/stories/2008/12/04/2437851.htm|title=Bauer keeps Melbourne Cup placing|date=4 December 2008|publisher=Australian Broadcasting Corporation|access-date=2009-01-26| archive-url= https://web.archive.org/web/20090130143541/http://www.abc.net.au/news/stories/2008/12/04/2437851.htm| archive-date= 30 January 2009 | url-status= dead}}
