The act superseded the Co-operative Associations Act, 1970, and was introduced by John Manley as Bill C-5 in the 36th Parliament of Canada on 25 September 1997.{{Cite web |title=Journals No. 4 - September 25, 1997 (36-1) - House of Commons of Canada |url=https://www.ourcommons.ca/DocumentViewer/en/36-1/house/sitting-4/journals |access-date=2024-02-14 |website=www.ourcommons.ca |language=en |archive-date=2024-02-15 |archive-url=https://web.archive.org/web/20240215031824/https://www.ourcommons.ca/DocumentViewer/en/36-1/house/sitting-4/journals |url-status=live }} The Bill was characterized as being a result of requests and model legislation by tertiary co-operative organizations - the Canadian Co-operative Association and Conseil canadien de la co-opération requesting modernization to permit greater capital investment, to harmonize with incoming provincial changes, to align with provisions in the Business Corporations Act, to permit mergers and to decrease bureaucracy. At the debate stage during second reading of the bill, the bill saw support except among the Bloc Quebecois, who wanted substantial amendments.{{Cite web |title=Debates (Hansard) No. 18 - October 22, 1997 (36-1) - House of Commons of Canada |url=https://www.ourcommons.ca/documentviewer/en/36-1/house/sitting-18/hansard |access-date=2024-02-14 |website=www.ourcommons.ca |language=en |archive-date=2024-02-15 |archive-url=https://web.archive.org/web/20240215004804/https://www.ourcommons.ca/DocumentViewer/en/36-1/house/sitting-18/hansard |url-status=live }} It was reported back from the industry committee with amendments which were adopted.{{Cite web |title=Committee Report No. 3 - INDY (36-1) - House of Commons of Canada |url=https://www.ourcommons.ca/DocumentViewer/en/36-1/INDY/report-3/ |access-date=2024-02-14 |website=www.ourcommons.ca |language=en |archive-date=2024-02-15 |archive-url=https://web.archive.org/web/20240215031823/https://www.ourcommons.ca/DocumentViewer/en/36-1/INDY/report-3/ |url-status=live }} At third reading, the bill passed without a recorded vote on 9 December, and with positive statements by the Bloc Quebecois, Liberals, NDP and Progressive Conservatives.{{Cite web |title=Debates (Hansard) No. 47 - December 9, 1997 (36-1) - House of Commons of Canada |url=https://www.ourcommons.ca/documentviewer/en/36-1/house/sitting-47/hansard#LINK200 |access-date=2024-02-14 |website=www.ourcommons.ca |language=en |archive-date=2024-02-15 |archive-url=https://web.archive.org/web/20240215004804/https://www.ourcommons.ca/documentviewer/en/36-1/house/sitting-47/hansard#LINK200 |url-status=live }}
There was some confusion raised in debate about whether the Saskatchewan and Alberta wheat pools were operating as co-operatives while being traded on an exchange, but those questions were unresolved in debate.{{Cite web |title=Debates (Hansard) No. 18 - October 22, 1997 (36-1) - House of Commons of Canada |url=https://www.ourcommons.ca/DocumentViewer/en/36-1/house/sitting-18/hansard |access-date=2024-02-14 |website=www.ourcommons.ca |language=en |archive-date=2024-02-15 |archive-url=https://web.archive.org/web/20240215004804/https://www.ourcommons.ca/DocumentViewer/en/36-1/house/sitting-18/hansard |url-status=live }}
