Creation and composition

The 1992 Ghana Constitution directs the legislature to establish a commission with mandate to be The National Human Rights Institution of Ghana, the Ombudsman of Ghana and an Anti-Corruption Agency and Ethics Office for the Public Service of Ghana. The commission was duly established in 1993 with the passage of the CHRAJ Act, Act 456.{{Cite web|last=|first=|date=|title=Ghana Constitution|url=https://constitutionnet.org/sites/default/files/Ghana%20Constitution.pdf|url-status=live|archive-url=https://web.archive.org/web/20201116221916/http://constitutionnet.org/sites/default/files/Ghana%20Constitution.pdf |archive-date=2020-11-16 |access-date=|website=}}

The commission is made up of a commissioner and two deputy commissioners, who are appointed by the President of Ghana under Article 70 of the Ghanaian constitution. The commissioner must be qualified to be a Justice of the Appeal Court and the deputies must be eligible to be justices of the High Court.

The first commissioner was Emile Short who retired in 2010, in 2004 he took an indefinite leave to serve as a Justice at the United Nations International Criminal Tribunal for Rwanda,{{Cite web|title=Judge Emile Francis Short Sworn In {{!}} United Nations International Criminal Tribunal for Rwanda|url=https://unictr.irmct.org/en/news/judge-emile-francis-short-sworn|access-date=2021-02-03|website=unictr.irmct.org}} his deputy Anna Bossman served as the acting commissioner in his absence.{{Cite web|title=Anna Bossman: I felt frustrated by ruling on Dr. Anane's case|url=https://www.modernghana.com/news/335456/anna-bossman-i-felt-frustrated-by-ruling-on-dr.html|access-date=2021-02-03|website=Modern Ghana|language=en}} He resume his post in 2009 and retired in 2010.{{Cite web|last=Public Agenda|date=3 August 2009|title=Emile Short Resumes Duty Today|url=https://allafrica.com/stories/200908031191.html|url-status=live|archive-url=https://web.archive.org/web/20121020085855/http://allafrica.com/stories/200908031191.html |archive-date=2012-10-20 |access-date=|website=}} Madam Lauretta Lamptey succeed him .{{cite news |url=http://www.ghanaweb.com/GhanaHomePage/NewsArchive/artikel.php?ID=214821 |title=Lauretta Lamptey appointed new CHRAJ Boss |access-date=1 August 2011 |work=General news |date=26 July 2011 |publisher=Ghana Home Page |archive-date=6 October 2012 |archive-url=https://web.archive.org/web/20121006174143/http://www.ghanaweb.com/GhanaHomePage/NewsArchive/artikel.php?ID=214821 |url-status=dead }} In July 2012, Joseph Akanjoluer Whittal was sworn in by President John Atta Mills as a deputy commissioner.{{cite web|title=Prez Mills swears-in Deputy Commissioner of CHRAJ|url=http://www.ghanaweb.com/GhanaHomePage/NewsArchive/artikel.php?ID=245343|work=General news|publisher=Ghana Home Page|access-date=6 August 2012 |date=20 July 2012}} Joseph Whittal was appointed by President Mahama to replace Lauretta Lamptey in 2016.{{cite web |title=Mahama confirms Joseph Whittal as CHRAJ boss |url=https://www.ghanaweb.com/GhanaHomePage/NewsArchive/Mahama-confirms-Joseph-Whittal-as-CHRAJ-boss-495837 |website=Ghanaweb.com |publisher=GhanaWeb |access-date=29 October 2018}}

The commission serves as an ombudsman receiving and dealing with complaints about the proper functioning of public institutions and to provide redress. It appears it can do same for private entities due to the way Article 218 (c) is written.
