The Act codified most common law crimes in the jurisdiction.{{cite journal|last=Tarrant|first=Stella|year=2013|title=Building Bridges in Australian Criminal Law: Codification and the Common Law|journal=Monash University Law Review|publisher=Monash University Faculty of Law|volume=39|issue=3|url=http://www.law.monash.edu.au/about-us/publications/monlr/issues/past/vol-39-3-tarrant.pdf|accessdate=30 May 2015}} Most crimes in this Act are indictable offences, whereas the Summary Offenses Act 1966 covers summary offenses.{{Cite web |last=Parliament of Victoria |author-link=Parliament of Victoria |title=Summary Offences Act 1966 |url=https://www.legislation.vic.gov.au/in-force/acts/summary-offences-act-1966/131 |access-date=2024-04-17 |website=legislation.vic.gov.au}} Indictable offenses are those which carry a penalty of more than 2 years imprisonment, and have a right to be heard in front of a jury, in the County or Supreme Court of Victoria. Indictable offenses can still be heard summarily, that is, in front of a single magistrate in the Magistrates' Court of Victoria.
