Trademark and litigation

Gosling Brothers has registered a version of the name that uses one apostrophe ('N), while the International Bartenders Association uses two apostrophes ('N').

In the United States, "Dark 'n Stormy" has been a registered trademark of Gosling Brothers Ltd of Bermuda since 1991.{{Cite news |url=http://www.thedailybeast.com/articles/2015/09/22/will-the-real-dark-n-stormy-please-stand-up|title=Will the Real Dark N' Stormy Please Stand Up?|last=Haglage|first=Abby|date=2015-09-22|newspaper=The Daily Beast |access-date=2017-07-08}} Gosling Brothers uses this registration to prohibit US marketing of a drink under the name "Dark 'n Stormy", or a related, confusing name, unless it is made with Gosling Black Seal rum.{{cite web|url=https://www.nytimes.com/2009/07/05/fashion/05shaken.html |title=The Right Stuff (by Law)|first=Jonathan|date=5 July 2009|work=New York Times|last=Miles|access-date=August 1, 2014}} Gosling's has litigated or threatened litigation over the mark against Pernod Ricard,{{Cite web|url=https://www.law360.com/articles/735000/a-toast-to-2015-wine-and-beer-trademark-disputes-part-2|title=A Toast To 2015 Wine And Beer Trademark Disputes: Part 2 - Law360|last=Kluft|first=David|date=2015-12-09|website=Law360|language=en|access-date=2017-07-06}} Proximo Spirits,{{Cite web|url=https://www.law360.com/articles/703237/rum-maker-says-rival-infringed-dark-n-stormy-trademark|title=Rum Maker Says Rival Infringed Dark 'N Stormy Trademark|last=Sullivan|first=Gail|date=2015-09-16|website=Law360|language=en|access-date=2017-07-06|url-access=subscription }} Infinium Spirits' Zaya, and a cocktail blog.{{Cite news|url=http://www.bevlaw.com/bevlog/alcohol-beverages-generally/a-courtroom-cocktail-gosling-brothers-and-a-dark-stormy-message|title=A Courtroom Cocktail: Gosling Brothers and a Dark, Stormy Message|last=Volz|first=Michael|date=2015-11-17|work=Bevlog|access-date=2017-07-06}}
