Supreme Court of India, in its judgement dated 10 July 2013 while disposing the Lily Thomas v. Union of India case (along with Lok Prahari v. Union of India),{{cite web | url=http://indiankanoon.org/doc/63158859/ | title=Lily Thomas vs Union of India & Ors. on 10 July, 2013 | publisher=indiankanoon.org | access-date=3 November 2013}} ruled that any Member of Parliament (MP), Member of the Legislative Assembly (MLA) or Member of the Legislative Council (MLC) who is convicted of a crime and given a minimum of two years' imprisonment, loses membership of the House with immediate effect. This is in contrast to the earlier position, wherein convicted members held on to their seats until they exhausted all judicial remedy in lower, state and supreme court of India. Further, Section 8(4) of the Representation of the People Act, which allowed elected representatives three months to appeal their conviction,{{cite web | url=http://indiankanoon.org/doc/1784702/ | title=Section 8 in The Representation of the People Act, 1951 | publisher=indiankanoon.org | access-date=22 October 2013}} was declared unconstitutional by the bench of Justice A. K. Patnaik and Justice S. J. Mukhopadhaya.{{cite news | url=http://www.thehindu.com/news/national/mps-mlas-to-be-disqualified-on-date-of-criminal-conviction/article4901596.ece | title=MPs, MLAs to be disqualified on date of criminal conviction | work=The Hindu | date=10 July 2013 | access-date=21 October 2013| last1=Venkatesan | first1=J. }}

Resistance from government

In an attempt to overturn this decision, the Representation of the People (Second Amendment and Validation) Bill, 2013, was introduced into the Rajya Sabha on 30 August by Law Minister Kapil Sibal; by the proposed amendment, representatives would not be disqualified immediately after conviction.{{cite web | url=http://newindianexpress.com/nation/Bill-for-no-immediate-disqualification-of-convicted-MPs-MLAs/2013/08/30/article1759870.ece | archive-url=https://web.archive.org/web/20130906052347/http://newindianexpress.com/nation/Bill-for-no-immediate-disqualification-of-convicted-MPs-MLAs/2013/08/30/article1759870.ece | url-status=dead | archive-date=6 September 2013 | title=Bill for no immediate disqualification of convicted MPs, MLAs | work=The New Indian Express | date=30 August 2013 | access-date=22 October 2013}} The Indian government also filed a review petition, which the Supreme Court dismissed.{{cite web | url=http://www.deccanchronicle.com/130904/news-current-affairs/article/sc-dismisses-govt-review-petition-convicted-politicians | title=SC dismisses govt review petition on convicted politicians, sticks to its stand | work=Deccan Chronicle| date=4 September 2013 | access-date=22 October 2013 | url-status=dead | archive-url=https://web.archive.org/web/20131023071641/http://www.deccanchronicle.com/130904/news-current-affairs/article/sc-dismisses-govt-review-petition-convicted-politicians | archive-date=23 October 2013}} On 24 September, a few days before the fodder scam verdict, the government tried to bring the bill into effect as an ordinance.{{cite news | url=http://www.thehindu.com/news/national/ahead-of-fodder-case-verdict-comes-ordinance-to-protect-lawmakers/article5164164.ece | title=Ahead of fodder case verdict comes ordinance to protect lawmakers | work=The Hindu | date=24 September 2013 | access-date=22 October 2013| last1=Gupta | first1=Smita }} However, Rahul Gandhi, then vice-president of the Indian National Congress, made his opinion of the ordinance clear in a press meeting: "It's complete nonsense.
