The picture is subject to copyright I (Zaps93) feel it is covered by the U.S. fair use laws because:

• It is used only in the article to which Fair Use is claimed.
• It does not limit the copyright owner's rights to sell the video game represented in any way.
• No free alternative that could enscapulate the situation here is available.
• It is a low resolution of a video game screen shot.
• It is used for visual purposes, to show a type of situation in the game.
