The author asserts that the image qualifies fair use for the following reasons:

1. Rockstar North and Rockstar Games have not release game screenshots into public domain.
2. The image is necessary to describe the appearance the game's gameplay and graphics; nothing else.
3. The screenshot is not intended to hinder the copyright owner's ability to sell the game.
4. This image is a screenshot and thus immediately falls in fair use.

The use of this image is covered by the U.S. fair use laws because:

1. Rockstar Games has released no such images into the public domain, and a replacement image could not be created that would adequately provide the same information.
2. It is a low resolution screenshot of a video game.
3. It does not limit the copyright owner's rights to sell the video game in any way.
4. The image is being used solely for informative purposes, as it serves to illustrate the game that popularized this genre.
