=== Protest ===

On Tuesday, November 19, Malloy filed a protest with the South Carolina Election Commission regarding the recount of the Senate District 29 race. The focus was on irregularities in the Lee County results. Chaplin and South Carolina Republican Party chair Drew McKissick responded with statements calling Malloy an 'election denier'.{{Cite web |date=2024-11-19 |title=Defeated South Carolina Senator Files Election Protest - FITSNews |url=https://www.fitsnews.com/2024/11/19/defeated-south-carolina-senator-files-election-protest/ |access-date=2024-11-19 |language=en-US}} Malloy asked for a new election if irregularities could not be remedied.Malloy, Gerald (November 19, 2024). "Election Protest" (PDF). Retrieved December 3, 2024.

The protest hearing was scheduled for December 3, 2024. If there was an appeal of the decision, it would be heard by the South Carolina Senate for a final decision, according to South Carolina law.{{cite news |last1=O'Toole |first1=Jack |date=2024-11-24 |title=Week in review: 'Crank' likely to stay in S.C. public high school libraries |url=https://charlestoncitypaper.com/2024/11/24/week-in-review-malloy-asks-for-new-election-in-senate-29-race |work=Charleston City Paper |language=en-us |access-date=2024-12-03}}

On Monday, December 2, the day before the scheduled hearing, Malloy conceded to Chaplin and withdrew his protest. Malloy stated in the withdrawal document that analysis was not possible because the state Election Commission would not make vote data available to his expert witness, Duncan Buell, a retired University of South Carolina computer science professor.{{cite news|last1=Holdman|first1=Jessica|date=2024-12-02|title=Final SC Democrat concedes Pee Dee area Senate race|url=https://scdailygazette.com/tag/2024-election-results|department= |work=South Carolina Daily Gazette|language=en-us|access-date=2024-12-03}}{{cite news|last1=Richardson|first1=Matthew|last2=Critzer|first2=Brian|date=2024-12-02|title=Senator Malloy's Notice of Withdrawal|url=https://www.fitsnews.com/wp-content/uploads/securepdfs/2024/12/Malloy_Withdrawal_of_Election_Protest_12.2.2024.pdf|work=FITSNews|language=en-us|location=South Carolina|access-date= }}
