North Carolina's 40th House district is one of 120 districts in the North Carolina House of Representatives. It had been represented by Democrat Phil Rubin since 2025. Geography

Since 2003, the district has included part of northwestern Wake County. The district overlaps with the 15th, 16th, and 18th Senate districts.
