Request to Clarify AG Letitia James’ Authority in Cuomo Investigation

I am requesting an edit to clarify a misleading statement regarding Attorney General Letitia James’ role in the sexual harassment investigation of Andrew Cuomo.

Issue with Current Text

The page currently states that “Attorney General Letitia James declined to press criminal charges against Cuomo.” However, this wording is misleading because it suggests that she had the authority to do so. Under New York law, the Attorney General cannot unilaterally file criminal charges without a referral from the governor or a state agency, which she did not have in this case.

Proposed Edit

Replace:

“Attorney General Letitia James declined to press criminal charges against Cuomo.”

With:

“Attorney General Letitia James did not file criminal charges against Cuomo, as her authority was limited to conducting a civil investigation. Under New York law, the Attorney General cannot initiate criminal charges without a referral from the governor or a state agency. Instead, the findings were referred to local district attorneys, who had the jurisdiction to determine whether criminal charges should be pursued.”
