• Image is a non-copyrighted work of the U.S. Government, which places the image in the public domain. Further, Oscars' own copyright terms permit digital use of the OSCAR as long as the "AMPAS" symbol also appears. Since it does, any copyright concerns are rendered moot. Just because I take a photo of a copyrighted work and release it under "public domain" doesn't mean it can be since copyrighted objects, buildings, subjects ect have more protection (of the copyright holder's) rights then the rights of the reproducer (the photographer). • Delete - Bit confused where does it say that this image is in the public domain, the source page says Photos for News Media Use Only the terms of use at http://si.edu/termsofuse/ say it cant be used for commercial purposes. So it really needs a fair use declaration to stay. In the end it is just being used for decoration you dont need a non-free image of four statues to support the text. The Smithsonian is a US Government agency, whose work is non-copyrightable and automatically in the [http://www.law.cornell.edu/uscode/17/usc_sec_17_00000105----000-.html public domain], unless there is a copyright notice to the contrary per Title 17, Chapter 1, § 105. The "Photos for News Media Use Only" you referenced, appears to refer to the additional links under "Related Content" at the bottom of the page. Also the terms of use at http://si.edu/termsofuse/ does say: "the Smithsonian allows personal, educational, and other non-commercial uses of the Content", which is what we are. But beyond that, you are correct that the same page also notes: "The Smithsonian welcomes you to make fair use of the Content as defined by copyright law." So in an abundance of caution, if you'd like me to add a fair use tag, I'll do that. Hepburn is the only performer, male or female, to have ever won four Oscars for acting. That's more than decoration. That's film history. And that also makes the achievement notable, noteworthy and deserving of a photo. :::Slight misunderstanding I fear educational, and other non-commercial uses of the Contents is not wikipedia we requires that media is free for any purpose including commercial. So as has been said not in the public domain and not usable on Wikipedia without a fair use declaration and you have to convince others that it meet the ten criteria at WP:NFCC, I suspect that #8 may be a problem. Again, I've linked that law for you to review. Don't really know what else there is. As for your WP:NFCC issue regarding #8, I actually believe that's the easiest to resolve. Again, Hepburn's 4 Oscars represent a notable one-of-a-kind historical & cultural achievement. That's not my view exclusively. It's the Smithsonian's view - proved by the fact that they built an entire exhibit displaying the 4 Oscars and acknowledging the achievement. That is not decorative, nor is this photo illustrating what the article references. Suggest you read the Smithsonian's [http://newsdesk.si.edu/releases/katharine-hepburn-s-oscars-view-aug-4-smithsonian-s-national-portrait-gallery own description] of the significance of the statutettes being displayed together. • Keep. The file now has a public domain tag as well as a fair use tag, which should be more than sufficient. NFCC #8 is addressed and satisfied within the fair use tag. The article makes significant and repeated mention of the achievement represented by the image. Also again, the Smithsonian Institute devotes an entire exhibition to the display of this image, and that itself flies in the face of any claim that the image is purely decorative. Perhaps non-American editors simply don't understand the significance of the Smithsonian's imprimatur. It is not conferred casually or capriciously. That U.S. government agency has more than aptly demonstrated the image is not decorative - but is historic. This important point remains undisputed. It's notability also remains indisputable. Deleting the image would substantially and unnecessarily weaken the very section of the article it illustrates and diminish the very achievement the article acknowledges. I think the pic does more than that: it shows how she was portrayed on the cover, in a very highly visible way that is not characteristic of singer-songwriters nor indeed of such plus-size women. As I have transferred over all the old versions to commons, there is no longer any reason to keep it on English Wikipedia. FindAGrave.com is not a valid source for images. The site's content is user provided and they don't care much about copyright. In any case, the image can no longer be found there. Nothing is know for sure about this image. We can't claim fair use. Damiens.rf 19:54, 25 May 2011 (UTC)

• Keep as no viable reason for deletion has been made. In virtually every sourcing standard (MLA, Chicago, etc) it says to cite where you found it, not who owns the source. Again, you should have just asked politely for the uploader to put in the source instead of nominating it for deletion. While we need to update the name of the actual copyright holder, this person is deceased and we cannot post a new picture of him. "Nothing is know for sure about this image"? Really? It looks pretty clear to me from the caption that he is playing the part of Gil Favor in Rawhide. He was a primary actor (paired with Clint Eastwood) on the fifth-longest running western TV show in the US. If you spent even a moment to look at how it's used in the article and clicked the given hyperlink, you'd see that CBS clearly owns the copyright. Even some of the earliest drafts of our NFC policy have recognised that. I've certainly tried to source images for bios I've contributed to, admittedly mostly for live people, and would consider a bio of someone sufficiently publicly notable to pass WP:NOTABILITY to be incomplete without one.
