Image is of an oil painting claimed to be in the public domain due to expired copyright on the basis of life of author + 100 years. Note that the stated author is "Artist Unknown" so that claim by itself seems unsupported. The second [http://www.hazegray.org/danfs/line/sotl.htm source link] provided however has explicit credit for the [http://www.hazegray.org/danfs/line/sol02.jpg image] stating "Oil painting by Rear Adm J. W. Schmidt". Schmidt died in 1981.
