- Image is stated to be a scan from the 1991 sixth edition of British Naval Aircraft Since 1912 by Owen Thetford, with the photo probably taken in 1916. British Naval Aircraft Since 1912 was first published in 1958, so while the original photo was taken during World War 1, there is no evidence presented to show that it was first published prior to 1 January 1923, which is needed for pd-us to apply. - You also have to determine whether or not the photo was published anywhere else before 1958. There is no evidence that the photo has never appeared anywhere but in British Naval Aircraft Since 1912, so before deleting one should present evidence that it has not. So, where did Owen Thetford get it from? Another possibility is to invoke the expiration-because-it-has-been-70-years-since-the-author's-death rule; if you are more comfortable with that, go ahead and change the license information, although you then raise th epossibility that the unknown photographer did not die prior to 70 years ago (1943). Frankly, I don't see how you can identify either the photographer's date of death or any exact first publication date, nor do I anticipate any copyright challenges for such an old, uncredited photograph. - The photo was published in J.M. Bruce's British Aeroplanes 1914–18, Putnam, London, 1957. UK rules (and it was taken in the UK) state that copyright expires for anonymous photos taken prior to 1957 70 years after creation if unpublished (which would be about 1986 or 87) or 70 years after publication if published within 70 years of creation (which could be as late as 2027 if Bruce was the first place it was published) (see [http://commons.wikimedia.org/wiki/Commons:Copyright_rules_by_territory/United_Kingdom]. For it to be out of copyright now in the UK would need it to have been published before 2013-70 = 1943. However, to be usable on en:wiki without a non-free justification, it also needs to be pd in the US (as the servers are located there). Owing to the Uruguay Round Agreements Act, it needs to have been out of copyright in the UK on 1 January 1996 for it not to have copyright restored in the US (see Wikipedia:Non-U.S. copyrights). This makes the key date 1996-70 = 1926, so to use this as a free-licenced photo, we need to show it was published before 1926.Nigel Ish (talk) 15:19, 20 January 2013 (UTC)
- Comment There is a possibility that an image like this might have been taken by the British government. In that case, {{tl|PD-UKGov}} applies. Unfortunately, it doesn't say whether it is a government work or not.
