The Miami Herald quoted ICRC spokesman Bernard Barrett about the images.
I'll try to contact him first, stating something like the following:

:Last September some images of Guantanamo captives, taken by ICRC representatives, to give to the captives' families, were subsequently republished. I'd like to establish who owns the intellectual property rights to these images, and whether they are being republished with the intellectual property owner's permission, and whether the wikimedia commons, a sibling project to the wikipedia, can get permission to use some or all of these images.
:On the wikimedia commons we only re-use images when the intellectual property owners have released permission for others to re-use the images. Intellectual property owners can release the image for re-use, while requiring the owner to be credited, by stating it is liscenced using a liscense like the "creative commons" with attribution and share-alike. Alternatively they could state they were putting the image into the public domain.
:If the Red Cross is the owner of this image of Khalid Sheikh Mohammed, and you agree to have it re-used on the wikimedia commons, could you please send an email to a member of the confidential committee that reviews permissions? In order to make sure we preserve the privacy of those who give permission to have their images re-used we have a select confidential committee of trusted contributors. They answer email sent to the committee's address. Only those trusted contributors are allowed to see the email from those who werite to that address.
:If, on the other hand, you gave over the intellectual property rights to the images to the families, when you gave them the images, could you forward this request to Khalid Sheikh Mohammed's family?
