Birds perfectly fit the category name, they are the first item listed at the disamb page Living dinosaurs, and there is nothing broken here. The nominator seems to have confused other editors that the pages mentioned are only about fiction. Hopefully the closer will not be a drive-by closer but will actually study this discussion and the pages mentioned and, if so, will find that the category "Living dinosaur" should stay as is and includes other than fiction.
