In December 2020 Costello, alongside fellow Green TD Neasa Hourigan, raised major concerns about the entry of Ireland into the Comprehensive Economic and Trade Agreement (CETA), a trade agreement between Canada and members of the EU, due to fears about the proposed investment court system. The investment court system is designed to act as a method of solving business disputes between investors and participating countries. Costello argued that the court system would allow Canadians investing in Ireland to sue the state if the state impeded their profits, such as with environmentalist laws, and this was a major threat to Ireland's sovereignty.{{cite news |last=O'Faolain |first=Aodhan |date=16 September 2021 |title=High Court dismisses Ceta challenge by Green Party TD Patrick Costello |url=https://www.irishtimes.com/news/crime-and-law/courts/high-court/high-court-dismisses-ceta-challenge-by-green-party-td-patrick-costello-1.4675783 |newspaper=The Irish Times |location= |access-date=1 August 2022}}{{cite news |last=O'Loughlin |first=Ann |date=29 March 2022 |title=Green TDs appeal against EU-Canada trade deal opens in Supreme Court |url=https://www.irishexaminer.com/news/courtandcrime/arid-40839815.html |work=Irish Examiner |location= |access-date=1 August 2022}} Costello suggested that the matter may need to be resolved by a referendum.{{cite news |last=Collins |first=Sarah |date=4 July 2022 |title=Ireland needs to act soon on EU-wide patent court referendum |url=https://www.independent.ie/business/irish/ireland-needs-to-act-soon-on-eu-wide-patent-court-referendum-41810542.html |work=Irish Independent |location= |access-date=1 August 2022}} In July 2021 Costello brought the matter before the High Court, arguing aspects of the trade deal would be unconstitutional.
